Riassunto

Il presente contributo esamina il più recente approdo della giurisprudenza di legittimità in tema di rapporti fra prescrizione del reato e confisca urbanistica. Con la pronuncia in commento, la terza Sezione penale della Corte di cassazione torna a ribadire la compatibilità fra l’irrogazione delle misure ablatorie e l’accertamento della intervenuta maturazione del termine di prescrizione del reato in data antecedente all’inizio del dibattimento, facendo così riaffiorare quei nodi interpretativi che parevano risolti dall’intervento chiarificatore delle Sezioni unite.

 

Prescription and confiscation of illegally parceled land: the principles of the Joint Sections are immediately questioned


This paper examines the most recent arrival of the Supreme Court case-law on the subject of the relationship between prescription of the crime and urban confiscation. With the judgment in question, the Court of Cassation reiterates the compatibility between the application of the ablation measures and the assessment of the maturity of the statute of limitations for the offense before the start of the trial, thus doing re-emerge those interpretative knots that seemed resolved by the clarification intervention of the United Sections.
