Riassunto
L’analisi del saggio dello studioso spagnolo Nieva-Fenoll si articola nella rivisitazione dei riferimenti testuali della Cassazione civile, oggetto di censure non sempre puntuali dell’autore spagnolo, poste a base della pretesa derivazione dell’istituzione dall’ordinamento inglese e non già da quello francese e offre l’occasione per ribadire i limiti del “modello puro” prefigurato dal Calamandrei alla stregua delle moderne teorie dell’interpretazione e della decisione e del principio di effettività delle garanzie del modello costituzionale del giusto processo, con conseguente mutata definizione della funzione nomofilattica della Corte di cassazione.
Consensus and disagreements on the origins of the cassation: the significant divergence from the model prefigured by Calamandrei of the function nomofilactic in the modern state.
The analysis of the essay by the Spanish scholar Nieva-Fenoll is divided into the revisitation of the textual references of the Civil Cassation, object of criticisms not always punctual by the spanish author, based on the alleged derivation of the institution from the English system and not from the French one and offers an opportunity to reiterate the limits of the "pure model" prefigured by Calamandrei in the same way as the modern theories of interpretation and decision and the principle of effectiveness of the guarantees of the constitutional model of due process, with a consequent change in the definition of the nomophilactic function of the Court of cassation.
