Riassunto
Con la cd. riforma Cartabia sono state introdotte una pluralità di ipotesi di intervento del giudice delle indagini preliminari – cd. “finestre di giurisdizione” – intese, nella prospettiva del legislatore, a meglio garantire la tutela della posizione della difesa anche in tale fase procedimentale. Nel lavoro, dopo aver ricordato come il professor Conso avesse più volte manifestato qualche perplessità in ordine alla assoluta “supremazia” che il pubblico ministero esercitava nella fase investigativa nell’originario disegno del nuovo codice, ci si domanda se il Maestro avrebbe apprezzato tali novità o invece colto il pericolo che le stesse conducano alla riproposizione della figura del “giudice istruttore”, chiaramente estranea al processo accusatorio.

With the cd. In the work, after recalling how Professor Conso had repeatedly expressed some doubts regarding the absolute "supremacy" that the public prosecutor exercised in the investigative phase in the original design of the new code, we ask ourselves whether the Maestro would have appreciated these innovations or instead, there was the danger that they would lead to the re-proposal of the figure of the "investigating judge", clearly extraneous to the accusatory process.
