Riassunto
Lo scritto prende le mosse dai principali pronunciamenti con cui le Corti europee hanno sindacato, direttamente o indirettamente, l’effettività del sistema dei controlli e la sua idoneità a rimuovere l’errore, per ripensare i limiti del controllo di legittimità e superare le resistenze che la giurisprudenza oppone ad un mutamento funzionale alla concreta tutela dei diritti.
Correspondence to the model in legitimacy judgments: new trends
The paper starts from the main judgements with which the European Courts have reviewed, directly or indirectly, the effectiveness of the control system and its suitability to remove the error, to rethink the limits of the last degree of judgement and the resistance that jurisprudence opposes to the real protection of fundamental rights.
