Riassunto
Il contributo muove dall’analisi della decisione della Suprema corte di cassazione, che si è occupata di ridefinire il momento d’accesso ai programmi di giustizia riparativa per quanto riguarda i detenuti sottoposti al regime differenziato ex art. 41-bis, co. 2 O.P., con particolare riferimento alle disposizioni della c.d. Riforma-Cartabia (d.lgs. n. 150/2022), per indagare le tensioni tra le esigenze di ordine e sicurezza che permeano tale regime penitenziario e l’applicabilità, in esso, della giustizia riparativa. La nota è volta a mettere in luce i nodi normativi e costituzionali sollevati dal conflitto tra il regime detentivo speciale e la finalità rieducativa della pena. L’approccio ermeneutico adottato dalla Corte, che non pare cogliere appieno l’innovatività della cultura riparativa oramai innestata nell’Ordinamento, viene letto alla luce di un’interpretazione sistemica del d.lgs. n. 150/2022. Quanto al profilo attuativo, il contributo distingue l’ammissibilità astratta del percorso riparativo dalla sua concreta attuazione, configurando l’eventuale coordinamento con il regime sospensivo come compatibilità selettiva, procedimentalizzata e subordinata alla preservazione della sua funzione preventiva. Un approfondimento è dedicato alla pretesa compatibilità tra l’esito riparativo e la valutazione della progressione trattamentale, anche alla luce delle restrizioni imposte dalla nuova formulazione dell’art. 4-bis O.P. La sopravvenuta introduzione della lett. f-bis) dell’art. 41-bis, co. 2-quater O.P. consente infine di spostare l’analisi dalla sola irrilevanza ratione temporis della novella alla questione sistematica della ragionevolezza di una preclusione assoluta ai programmi riparativi. Infine, si riflette sulla possibilità di conciliare le esigenze di sicurezza con un modello di pena più inclusivo e costituzionalmente orientato, aprendo il dibattito sull’evoluzione del sistema penale verso un paradigma riparativo e pacificatore.
Restorative Justice and Sentence Enforcement: The Supreme Court’s Decision and the Boundaries of a New Understanding of Punishment
This article analyses a decision of the Italian Court of Cassation concerning the timing of access to restorative justice programmes for prisoners subject to the special detention regime under Article 41-bis (2) of the Prison Act, with particular regard to the provisions introduced by Legislative Decree no. 150/2022, the so-called Cartabia reform. It examines the tension between the order and security requirements that underpin that prison regime and the possible operation of restorative justice within it. The case note highlights the statutory and constitutional issues raised by the conflict between special detention and the rehabilitative purpose of punishment. The Court’s interpretive approach, which does not appear fully to grasp the innovative significance of the restorative culture now embedded in the Italian legal system, is assessed in the light of a systemic reading of Legislative Decree no. 150/2022. As to the practical dimension of implementation, the article distinguishes the abstract admissibility of restorative justice from the concrete modalities of its operation, construing any coordination with Article 41-bis as selective, procedurally structured and subject to the preventive function of the special regime. Attention is paid to the compatibility between a restorative outcome and the assessment of treatment progression, including in view of the restrictions introduced by the revised wording of Article 4-bis of the Prison Act. The subsequent introduction of letter f-bis) of Article 41-bis(2-quater) of the Prison Act finally shifts the analysis from the temporal irrelevance of the amendment in the case at hand to the broader systemic question of the reasonableness of a blanket exclusion from restorative justice programmes. The article finally considers whether security needs can be reconciled with a more inclusive and constitutionally oriented model of punishment, thereby opening the debate on the evolution of the penal system towards a restorative and peace-building paradigm.
