Riassunto
Il meccanismo di riapertura delle indagini è il crocevia di tre fondamentali istanze che andrebbero attentamente contemperate: a) la realizzazione della potestà punitiva, che implica anche la possibilità del pubblico ministero di aprire nuovi scenari investigativi contro la medesima persona dopo un provvedimento di archiviazione; b) l’efficienza del sistema, che impone di avviare indagini inutili perché infruttuose; c) la tutela delle garanzie individuali. Su queste basi, il presente lavoro ruota attorno a una idea di fondo: il carattere eccezionale del meccanismo di riapertura delle indagini, il quale non dovrebbe mai costituire il comodo rimedio di errori investigativi passati. Di qui la ricerca di un punto di equilibrio tra l’autonomia e l’indipendenza investigativa del pubblico ministero e l’efficacia dei controlli giurisdizionali, con l’obiettivo di evitare appiattimenti dei giudici sulle eventuali narrazioni investigative unilaterali dell’accusa, riducendo così il rischio della duplicazione dell’errore investigativo. In questa prospettiva, occorre riflettere sull’opportunità di un coinvolgimento attivo della difesa nel cruciale momento autorizzativo: per offrire al giudice un punto di vista più ampio, articolato, differente, capace di spezzare quella narrazione unilaterale; un contributo difensivo che consentirebbe forse di prevenire errori futuri orientando le nuove indagini nella giusta direzione.
Reopening of investigations and the risk of a double investigative error. Strategies of the prosecutor and judicial review
The mechanism for reopening investigations lies at the crossroads of three fundamental considerations that should be carefully balanced: a) the exercise of punitive authority, which also entails the public prosecutor’s ability to explore new lines of inquiry against the same individual after dismissing the case b) the efficiency of the system, which requires that investigations deemed futile be discontinued; c) the protection of individual rights. On this basis, this paper centres on a fundamental idea: the exceptional nature of the mechanism for reopening investigations, which should never serve as a remedy for past investigative errors. Hence the search for a balance between the prosecuting authority’s investigative autonomy and independence and the effectiveness of judicial oversight, with the aim of preventing judges from simply rubber-stamping any unilateral investigative narratives put forward by the prosecution, thereby reducing the risk of repeating investigative errors. This leads to a consideration of whether the defence should be actively involved at this crucial stage of authorisation: to offer the judge a broader, more nuanced and different perspective, capable of challenging that one-sided narrative; a contribution from the defence that might help to prevent errors by steering any new investigations in the right direction.
