Riassunto
Attraverso un excursus di sentenze della Suprema Corte, la Prima sezione ha ripercorso la “storia” del giudicato parziale, le opinioni dottrinali e giurisprudenziali che hanno fatto sorgere diverse questioni: il passaggio in giudicato di una pronuncia può avvenire non contemporaneamente per tutte le sue parti? Quali delle sue parti sono idonee a passare in giudicato autonomamente? Il capo della responsabilità può essere scisso da quello della pena? Se sì, può porsi in esecuzione, insieme al capo relativo alla responsabilità, una pena minima, correttamente individuata, prima che la questione circa il quantum sia perfettamente definita? E se anche ciò fosse possibile, quali conseguenze si porrebbero sulle pronunce dei giudici di rinvio, sulla classificazione dell’individuo quale imputato o condannato e sulla pena? Proprio queste incertezze hanno spinto la Prima sezione a rimettere la questione alle Sezioni unite.
The “schizophrenia” of the judgment between accountability and sentence
Through an excursus of the Supreme Court rulings, the First section retraced the partial judgment "history", the doctrinal and jurisprudential opinions that have given rise to various questions: may a judgement become final not at the same time for all its parts? Which of its parts are suitable for become final independently? Can the responsibility section be detached from the penalty? If so, can a correctly identified minimum penalty be enforced, together with the liability section, before the question of quantum is perfectly defined? And even if this were possible, which consequences would be placed on the sentences of the referring courts, on the classification of the individual as defendant or convicted and on the sentence? Precisely these uncertainties convinced the First Section to refer to the United Sections.
