Riassunto
Immobile nella selva di smottamenti codicistici, l’art. 358 c.p.p. esibisce innate doti camaleontiche: disposizione sempre identica a sé stessa, riesce a riflettere mutamenti sistematici e culturali, cambiando ciclicamente significato; finanche nei tempi più recenti. Il contributo si propone di ricostruirne l’origine, le cangianti esegesi e il suo fondamento più autentico, nella prospettiva di una rinnovata completezza investigativa foriera di regole di condotta per il pubblico ministero e per il giudice, verso la cui riscoperta sollecitano le ultime riforme e i più moderni assetti del sistema processuale penale.
Investigations in Favour of the Suspect
Standing firm amidst the shifting sands of the Code’s provisions, Article 358 of the Code of Criminal Procedure displays innate chameleon-like qualities: while remaining outwardly unchanged, it manages to reflect systemic and cultural shifts, cyclically altering its meaning—even in very recent times. This article aims to reconstruct the provision’s origins, its evolving interpretations, and its most authentic foundation, with a view to achieving a renewed standard of investigative completeness that establishes rules of conduct for both the public prosecutor and the judge—a rediscovery prompted by recent reforms and the modern structure of the criminal procedural system.
