Le Sezioni unite hanno esteso il meccanismo di rinnovazione dell’istruzione dibattimentale disciplinato dall’art. 603, co. 3-bis, c.p.p. alle dichiarazioni del testimone esperto. Ripercorsa la trama argomentativa della Suprema Corte, il contributo offre qualche spunto di riflessione sull’adattamento dell’istituto alla prova scientifica, nonché sul diritto delle parti all’ammissione della perizia. 

The Joint Chambers define the relationship between the renewal of the trial in appeal and the statements of the expert witness

The Joint Chambers have extended the mechanism of renewal of the trial governed by the art. 603, co. 3-bis, c.p.p. to the statements of the expert witness. Retraced the reasoning of the Supreme Court, the paper offers some points of reflection on the adaptation of the institute to the scientific evidence, as well as on the right of the parties to the admission of the expertise.
