Old and new issues concerning the right to an interpreter for the non-native speaker defendant
Recognition of the right to the assistance of an interpreter in favour of the accused who does not know italian language, in our criminal procedure system, came about very late: unknown in the Code of Criminal Procedure of 1930, but already inferable from the principles affirmed in the Constitution and then solemnly sanctioned by the European Convention on Human Rights, it was only in 1988, with the approval of the new procedural code, that it received express regulation, subsequently enhanced in 2014. But, at the level of practical application, difficulties remain that are not easy to overcome.
