Riassunto
La Corte di cassazione analizzando nel complesso il giudizio di rinvio, si sofferma sulla qualifica del predetto giudizio distinguendolo in prosecutorio e restitutorio, approfondendone le diversità e le analogie, sottolineando il rapporto con la pronuncia cassata e le dirette conseguenze, tra cui i poteri del nuovo giudice chiamato a pronunciarsi sulla questione, senza tralasciare una questione strettamente correlata, quale quella della rinnovazione dell’istruttoria dibattimentale nel giudizio di rinvio, in particolare la riassunzione della prova dichiarativa.
