Riassunto

La Corte costituzionale con la pronuncia in commento torna sul tema del diritto al silenzio dell’accusato sulle proprie qualità personali, ossia sulle ulteriori informazioni di cui all’art. 21 disp. att. c.p.p. 

La questione, di cui la medesima Corte già si era occupata in una precedente ordinanza del 1976, ruota attorno all’estensione del diritto di difesa dell’indagato/imputato nel suo procedimento penale, inteso sia come diritto al silenzio, che come diritto al mendacio.

La Corte, con la recente sentenza, giunge ad affermare il diritto al silenzio dell’accusato anche alle domande sulle circostanze di cui all’art. 21 disp. att. c.p.p., senza il pieno, però, anche del diritto a mentire.

The Constitutional Court, in its ruling under review, revisits the issue of the accused's right to silence regarding their personal qualities, specifically the additional information referred to in Art. 21 of the implementing provisions of the Code of Criminal Procedure.

The matter, which the same Court had already addressed in a previous ordinance in 1976, revolves around the extent of the defense rights of the suspect/defendant in their criminal proceedings, understood both as the right to silence and the right to lie.

In its recent ruling, the Court asserts the accused's right to silence even concerning questions about the circumstances referred to in Art. 21 of the implementing provisions of the Code of Criminal Procedure, though not extending this to a full right to lie.
