 Walking backwards: some considerations on the changes made to the juvenile penitentiary law by the "Caivano decree”

The paper examines the amendments to Legislative Decree no. 121/2018 made by the so-called "Caivano Decree", converted into Law no. 159/2023, aiming at increasing the number of cases in which it is possible to expel the young adult from the "special" penitentiary circuit. This comes with the hope to overcome the worrying trend of homogenizing the children’s justice to the adults’ one and to implement a differentiated treatment for the children according to their needs.
