Prendendo spunto da una diffusa ma censurabile tendenza ad equiparare separazione delle funzioni e separazione delle carriere, il contributo si pone come obiettivo quello di illustrare le ragioni per cui la seconda e non anche la prima si ponga quale necessario completamento di un assetto processuale che dia piena attuazione al valore della terzietà del giudice, in linea con quanto statuito – oramai molti anni orsono - in tema di giusto processo dall'art. 111 Cost.
Why the separation of functions alone cannot ensure the effective implementation of Article 111 of the Italian Constitution
Taking inspiration from a widespread yet objectionable tendency to equate the separation of functions with the separation of careers, this contribution seeks to set out the reasons why the latter but not the former should be regarded as a necessary complement to a procedural framework capable of giving full effect to the value of judicial impartiality, in line with what was established—now many years ago—with regard to due process by Article 111 of the Italian Constitution.
